Buying

Selling
When selling a property, whether it be Residential or Commercial, you will require a Vendors Section 32 Statement which is an information statement that you as a Vendor are required to provide to a Purchaser prior to a Contract of Sale being entered into.
The Section 32 Statement contains information relating to rates, taxes and charges, insurance, restrictions, planning, zoning, notices, building permits, easements, covenants and other applicable registered agreements, restrictions, caveats, charges and notices. At JP Conveyancing Works we ensure that we keep up to date with all changes in legislation and all aspects of Conveyancing to ensure that the advice and documentation prepared and provided by us is accurate, especially the Section 32 Statement, as a defective Section 32 Statement can render a Contract of Sale voidable at the Purchasers option up until Settlement, regardless of the status of the Contract. Our service covers all aspects of selling you property from preparing the Vendor Section 32 Statement through to settlement. Different unforeseen circumstance do occur and sometimes changes in your circumstances may mean that you need to have the Title to your property transferred or altered. These circumstance could be because you have married or separated, are purchasing additional shares in the property, are changing the percentage of ownership in the property, are removing one party for asset protection, refinancing, due to devise in Will and so forth.
At JP Conveyancing Works we are able to arrange for the Certificate of Title to be transferred, altered or amended as required by you and/or your circumstance. We arrange all of the required Transfer and Stamp Duty documentation to be drawn up and if you have a mortgage over the property, we arrange consent from your Mortgagee to make the alteration/amendment to the Title and upon your Mortgagee making the original Certificate of Title available at the Land Titles Office, we attend to the lodgement of the Transfer documentation, all of which is included in our fixed fee service. Stamp Duty Refunds
If at the point of Settlement you are/were unable to have a Stamp Duty Concession applied in which you are entitled to, we can arrange for the over payment in Stamp Duty to be refunded to you.
Circumstance where you have not received the Stamp Duty Concession at settlement could be, you are a first home buyer of land and your First Home Owners Grant was not approved prior to settlement or you hold a eligible pension/concession card and you are either purchasing land or your bank will not allow for the concession/exemption at Settlement or you initially purchased the property for investment, however you have now moved into the property as your primary residence. No matter your circumstance, if you did not receive the Stamp Duty Concession at Settlement that you were entitled to, we can on your behalf, apply for the refund of the over payment of Stamp Duty. First Home Owners Grant
If you have purchased a property and were entitled to receive the First Home Owners Grant, however, for whatever reason the First Home Owners Grant Application was not submitted or processed prior to Settlement and you have not received the Grant, we can on your behalf submit the Application to the State Revenue Office and have the Grant paid to you post Settlement.

Lost Title Application
If you own a property that is unencumbered (have no registered mortgage on Title), you or your Conveyancer/Solicitor will hold the Original Certificate of Title which is required when selling, transferring or mortgaging the property. However, should the Original Certificate of Title become Lost, Stolen or Destroyed, prior to selling, transferring or mortgaging the property, you will need to have a ‘Lost Title Application’ submitted to the Land Titles Office (Land Use Victoria).
Our Team at JP Conveyancing Works can arrange the Application on your behalf and undertake all the required searching/investigating as to the whereabouts of the Certificate of Title since issuing from Land Use Victoria, which includes obtaining a Statutory Declaration from each person whose hands the Title has passed through between issuing from Land Use Victoria and becoming Lost, Stolen or Destroyed.
